1. Non-government employees taking bribesAccording to Article 163 of the Criminal law of the PRC, if the staff of a company or other entity take advantage of their position to obtain property from others or accept property from others in return for the benefit they provide, or, in business activities, take advantage of their positions, accept kickbacks and handling fees of various types, in violation of state regulations, in the event the amount is more than 60,000 yuan and less than 1 million yuan, they shall be prosecuted and sentenced to a fixed-term imprisonment of no more than five years; in the event the amount is more than 1 million yuan, which is defined as "a large amount", the staff shall be sentenced to a fixed-term imprisonment of no less than five years, and may also be subject to confiscation of property.


2. Offering bribes to non-government employeesAgain according to Article 163 of the Criminal Code, giving property to staff of a company or other entity, in order to obtain improper benefits, constitutes bribery. If the amount of the bribe offered by the individual is more than 60,000 yuan or less than 2 million yuan, or if the amount of the bribe offered by a company is more than 2 million yuan, it shall be identified as "a large amount" and a case shall be filed for prosecution. The offender shall be sentenced to a fixed-term imprisonment of no more than three years or criminal detention.If the amount of the bribe is more than 2 million yuan, it shall be identified as "a huge amount" and carry a sentence of a fixed-term imprisonment of no less than three years and no more than ten years, and pay a fine.
